How Might Federal Policy Impact Independent Schools in 2019?

(from NAIS) What regulations, legislation or rulings coming out of Washington this year might impact independent schools? These five items stand out to NAIS's legal counsel and staff attorney:

  • The U.S. Department of Education’s proposed rule revamping obligations regarding sexual harassment and assault under Title IX is accepting comments until January 28, 2019. 
  • The U.S. Department of Labor will release a new proposed rule regarding overtime pay in March. 
  • The Department of Homeland Security plans to release a rule in September that sets a strict time limit for all F-1 student visas and potentially causes some restrictions for students.
  • The IRS may put forward additional guidance on UBIT siloing and transit/parking UBIT compliance under the tax reform act, and efforts on Capitol Hill to repeal the transit/parking tax continue. 
  • The U.S. Supreme Court is deciding if it will hear one of several pending cases questioning whether Title VII’s prohibition on sex discrimination in employment covers LGBTQ employees.
